South Korean President Yoon Seok-yoon refused to be summoned for the investigation three times, and an arrest warrant was approved.
Yonhap news Agency reported that South Korea's legal circle on Tuesday (December 31) news, the Seoul Western District Court issued an arrest warrant for Yoon Seok-yuet on the same day, which is the first time in South Korea's constitutional history to take compulsory measures against a sitting president.
Meanwhile, the Seoul Western District Court also issued a search warrant for Yoon. It is expected that the Senior Public Officials Crime Investigation Branch (TIAO) will soon conduct a search mission at the presidential residence. Generally, arrest warrants are valid for one week.
Yoon, who was impeached and suspended by the National Assembly on December 14, was summoned three times in absentia without reason, and the investigation team requested an arrest warrant from the Seoul Western District Court on December 30.
According to South Korea's Criminal Procedure Law, if a suspect refuses to appear in court three times without valid reasons, the investigating authority can apply for an arrest warrant.
On Dec. 3, Mr. Yin abruptly declared martial law on the grounds of "maintaining a free constitutional order," but his purpose was widely seen as cracking down on political opponents. Martial law forces tried to force their way into the National Assembly on the same day, causing political turmoil. South Korea's National Assembly quickly passed an impeachment resolution suspending Yoon from the presidency while an investigation is launched.
South Korea's Senior Public Officials Crime Investigation Agency, the Special investigation team of the National Investigation Headquarters of the National Police Agency and the investigation headquarters of the Ministry of National Defense jointly formed a "martial law joint investigation team" to conduct a comprehensive investigation into Yoon's orders and actions.
The Public Mediation Office previously summoned Yin Xiyue to attend the investigation as a leader of the civil unrest and a suspect of abuse of power, but Yin Xiyue did not attend the investigation summons on December 18, 25 and 29 three times, and did not provide a reasonable explanation. Accordingly, the investigation team applied for an arrest warrant at the Seoul Western District Court on December 30.
