The game behind Yin Xiyue's release

On March 7th local time, the Seoul Central District Court approved President Yoon Suk yeol's request to lift his detention. The president, who was deeply accused of impeachment and civil unrest, ended his two month detention and continued to be tried in a non detention state. This ruling is like a heavy bomb, instantly plunging the already volatile South Korean political arena into intense turbulence. Behind it lies a complex game of interests among all parties, and it also foreshadows many uncertainties in the future political direction of South Korea.

The direct reason for Yin Xiyue's release is that the court determined that there were flaws in the prosecution's prosecution process. The Seoul Central District Court believes that Yoon Seok yeol was charged after the detention period had expired, and the calculation of the detention period should be based on the actual time (hours, minutes), rather than the prosecutor's belief that it should be calculated on a daily basis. Moreover, there are issues with the investigation authority and transfer procedures between the Korean Public Prosecutor's Office and the prosecution. The investigation authority of the Public Prosecutor's Office does not include the crime of internal strife, and both parties have jointly negotiated and allocated detention periods without legal basis, without fulfilling the necessary transfer procedures.

Behind this ruling is a fierce legal game between the lawyer team of Yin Xiyue and the prosecution. The legal team accurately seized the time loophole of the prosecution, questioned the legality of the detention, and emphasized that the prosecution's prosecution after the detention period ended was a procedural violation. The prosecutor insisted that the prosecution was carried out within the legal detention period, and both sides held their own views. The court's ruling undoubtedly favored Yin Xiyue's side. But this does not mean that Yin Xiyue has no worries at the legal level. He still faces criminal trials for impeachment and civil unrest charges, and whether the prosecution will appeal and how the case will proceed are full of variables.

From the perspective of evidence, the prosecution may also face the dilemma of insufficient evidence. Despite the accusation of civil unrest against Yin Xiyue, in the actual investigation, it may not have been possible to obtain ironclad evidence that he "directly ordered the outbreak of civil unrest". In South Korea's judicial system that values evidence, the lack of evidence puts prosecutors at a relative disadvantage in this legal game, which also provides an opportunity for Yoon Seok yeol's release.

The National Power Party welcomes the court's ruling, with party leader Quan Ningshi emphasizing that Yin Xiyue "should not have been arrested in the first place". He believes that the court's decision indicates that the rule of law still exists, and that the execution of the arrest warrant by the Public Mediation Office is wrong. Behind this, on the one hand, it is necessary to maintain unity within the party and her own political interests. As the core figure of the ruling party, Yin Xiyue's fate is closely related to the ruling party; On the other hand, the National Power Party also attempted to take this opportunity to attack the opposition party, accusing the Democratic Party of using the Yoon Suk yeol issue to disrupt national politics.

The Common Democratic Party expressed strong dissatisfaction with the court's ruling, condemning it as a "privileged justice" and calling on the prosecution and police to quickly arrest Yin Xiyue and isolate him from the world. They also hope that the Constitutional Court will make a prompt judgment. The opposition party is well aware that if Yoon Suk yeol resumes the presidency, it will pose a significant threat to their political interests, and therefore will do their utmost to prevent this from happening. They not only criticize the release of Yin Xiyue in public opinion, but may also increase pressure in the subsequent impeachment trial of the Constitutional Court, and "influence" the ruling of the Constitutional Court through various means.

In terms of the international situation, Yoon Seok yeol's governing style and foreign policy have had a significant impact on South Korea's international relations. During his tenure, he vigorously promoted the "pro American and anti North Korean" policy and strengthened military cooperation with the United States, which to some extent affected the stability of the situation on the Korean Peninsula. If Yin Xiyue is reinstated as president, this policy may continue to be implemented, accelerating the deployment of the "Difeng" missile system and further exacerbating regional tensions; If he is impeached and removed from office, the opposition party's Common Democratic Party's advocacy of "balanced diplomacy" may lead to a shift in South Korea's foreign policy, and North Korea may also take the opportunity to ease tensions. The process of denuclearization negotiations on the Korean Peninsula may undergo new changes.

The release of Yoon Seok yeol is only a temporary result of South Korea's political game, not the end point. In the future, the ruling of the South Korean Constitutional Court on the impeachment case will be crucial. If the impeachment is passed, Yoon Seok yeol will be officially dismissed and South Korea may hold early elections; If the impeachment is dismissed, Yoon Seok yeol will be reinstated to the presidency, but his criminal trial for the crime of internal strife will continue. This political game not only concerns the personal political fate of Yoon Seok yeol, but also profoundly affects the domestic political landscape, social stability, international status, and diplomatic relations of South Korea. It also provides a unique perspective for global observation of South Korea's political development.
