The US government has asked the Supreme Court to overturn the temporary ban on layoffs and restructuring of federal agencies

The US government filed an appeal with the Supreme Court on Monday (June 2nd), demanding the revocation of the temporary injunction previously issued by the federal court that prevented federal agencies and the Department of Government Efficiency from advancing large-scale layoffs and institutional restructuring plans.

Xinhua News Agency reported that Saul, the deputy Attorney General of the US Department of Justice, said in the appeal that the control of personnel in federal agencies is at the core of the president's power, and the president can exercise his core constitutional power without special permission from Congress.

On May 30, the Ninth Circuit Court of Appeals of the United States rejected the appeal of the Trump administration and upheld a temporary injunction previously issued by Judge Ilston of the Federal District Court for the Northern District of California, which prevented federal agencies and the Department of Government Efficiency from advancing large-scale layoffs and institutional restructuring plans. The Ninth Circuit Court of Appeals held that implementing large-scale layoffs and institutional restructuring would have a significant impact on numerous areas such as the National Food Safety System and veterans' healthcare in the United States. Therefore, the execution should be suspended during the litigation period.

California Judge Ilston issued a two-week temporary injunction on May 9, requiring federal agencies to suspend the implementation of the relevant executive order signed by Trump in February and the memo subsequently issued by the White House Office of Management and Budget. He also demanded that federal agencies revoke any layoff decisions issued under Trump's executive order, restore the positions of government workers on administrative leave, and provide corresponding compensation. On May 22nd, the court ruled again to extend the ban indefinitely. The United States Department of Justice filed an appeal with the Ninth Circuit Court of Appeals the next day.
